Annulment or Divorce

In Michigan, you have two options in ending a marriage.  There is annulment and divorce.  An annulment is different than a divorce in a number of ways.  First, you must qualify or prove the facts to get an annulment.  You can get an annulment in Michigan by establishing fraud, duress, or nonconsummation of the marriage (not length of time).  An annulment is treated as if the marriage never occurred.

In contrast, Michigan has “no fault” divorce.  To get a divorce you merely have to state there has been a breakdown in your marriage.  You do not have to prove fault.  It is easier to get a divorce than an annulment.  Next, a divorce recognizes the marriage as being valid and ends the marriage (different from annulment).

This can make a difference is certain circumstances.  If there are retirement accounts accumulated or other assets, they are returned to the person who owns them in an annulment.  In a divorce, assets accumulated during a marriage are divided regardless of who owns the asset.
